Terms of Service

1. Agreement to Terms

By creating an account on or using the Dszape platform ("Platform"), you agree to these Terms of Service ("Terms"). If you are using the Platform on behalf of a business, you represent that you have the authority to bind that business to these Terms. If you do not agree, you may not use the Platform.

2. What Dszape Provides

Dszape is a multi-tenant hotel management SaaS platform. We provide:

  • Hotel website builder with customizable templates
  • Direct booking engine with integrated payment processing
  • Front desk operations: calendar, check-in, checkout, guest management
  • Billing and folio management with tax configuration and invoice generation
  • Team management with role-based access control
  • Property management tools: room types, availability, pricing, services

We host your hotel website on a subdomain (yourhotel.dszape.com) or your custom domain (Pro tier and above).

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for all activity that occurs under your account
  • You must maintain the security of your login credentials
  • You must notify us immediately at evan@dszape.com if you suspect unauthorized access
  • One Dszape account may manage multiple properties (Scale tier)

4. Subscription Plans and Pricing

Tiers:

  • Free: $0/month — website, booking engine, basic management
  • Pro: $49/month — custom domain, dynamic pricing, guest app, email automation
  • Scale: $79/month — channel manager, multi-property, POS, priority support

Payment processing:

All tiers include a 1.5% transaction fee on bookings processed through the Platform. This fee is in addition to any fees charged by the payment processor (Stripe or Razorpay, depending on your region). Subscription fees are billed monthly in advance. You may upgrade, downgrade, or cancel at any time through the dashboard.

Price changes:

We may adjust pricing with 30 days' written notice. Price changes do not apply retroactively. If you disagree with a price change, you may cancel before the new price takes effect.

5. Your Content and Data

You own your data. All property information, photos, guest records, booking data, and financial records you create on the Platform remain your intellectual property.

By uploading content to the Platform, you grant Dszape a limited, non-exclusive license to display that content on your public hotel website, booking pages, and within the Platform dashboard — solely for the purpose of operating the service.

You are responsible for ensuring you have the right to use all content you upload (photos, text, logos). You must not upload content that infringes on third-party intellectual property rights.

6. Hotel Operator Responsibilities

As a hotel operator using the Platform, you are responsible for:

  • The accuracy of your room availability, pricing, and property information
  • Correct tax configuration for your jurisdiction (GST, VAT, local taxes)
  • Honouring bookings made through the Platform
  • Compliance with local hospitality regulations, licensing, and guest registration laws
  • Handling guest disputes, cancellations, and refunds according to your stated policies
  • Maintaining accurate cancellation and refund policies on your booking pages

Dszape provides the tools. You provide the hospitality. We are not a party to the agreement between you and your guests.

7. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose
  • Upload malicious code, spam, or content that violates others' rights
  • Attempt to access other users' data or bypass security measures
  • Resell or sublicense Platform access without written permission
  • Misrepresent your property, amenities, or pricing to guests
  • Use the Platform to operate properties involved in illegal activities

We reserve the right to suspend or terminate accounts that violate these terms.

8. Platform Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control (infrastructure provider outages, internet disruptions, force majeure). For real-time status updates, visit our status page.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Dszape is provided "as is" without warranties of any kind, express or implied
  • We are not liable for lost revenue, overbookings, or guest disputes arising from your use of the Platform
  • We are not liable for errors in tax calculations resulting from incorrect tax configuration by the hotel operator
  • Our total liability for any claim shall not exceed the fees you paid us in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages

10. Cancellation and Data Export

You may cancel your subscription at any time through the dashboard. Upon cancellation:

  • Your hotel website will be unpublished immediately
  • You will retain dashboard access until the end of your billing period
  • You may export all your data (bookings, guest records, financial records) before cancellation
  • After 90 days of account inactivity post-cancellation, we will permanently delete your data (except where retention is legally required)

11. Intellectual Property

The Dszape name, logo (including the gorilla mark), brand identity, website templates, and Platform code are the intellectual property of Dszape. You may not copy, modify, or distribute our templates, code, or brand assets without written permission.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration in Goa, India, under the Arbitration and Conciliation Act, 1996. This does not affect your statutory rights under consumer protection laws in your jurisdiction.

13. Changes to These Terms

We may update these Terms with 30 days' notice via email or dashboard notification. Material changes will be clearly highlighted. Continued use of the Platform after the notice period constitutes acceptance.
